A couple of weeks ago, we had a session on GDPR and its compliance in Zoho. The session brought in questions around a host of Zoho products and how they comply with GDPR. Popular feedback said the session was quite useful.

Owing to this and several questions centering around Zoho's privacy policy, we're rolling out another session of Ask the Experts this May 24th and 25th, which invites questions on Zoho's Privacy policy and its compliance with the General Data Protection Regulation. (Please try and ask topic related questions) 

You know how this plays out. For the uninitiated, we have a panel of experts from our Legal and product teams set to offer answers. Post your questions as comments to this post.

Its very annoying. Seriously i don't like it . Please make an option to old version don't create a barrier for us.

@Marketing Crushaders,

Currently it is not possible to bring back the old interface. We are working on certain features based on the collective feedback on what the users miss in the new version. Those features will be added to the new interface down the line.

This specific discussion is focussed on GDPR and we welcome your questions about that. We request you to either email us or start a different thread for other topics.

Currently, the consent form tracking only allows a breakdown of ALL leads, how can I segment this to only ACTIVE (recent) leads that I want? We're currently housing many old leads that I'm continuously vetting. I don't want to appear BEHIND in consent gathering (with rolled out globally). Could you please mention the Zoho product you are referring to so that we can ask the relevant team to answer your query?

I recently joined Zoho Invoices as a new customer, because my previous supplier wasn't going to be compliant with GDPR.

A few questions I have is:

- How can I collect all data from users when they request us for data access and data transfer?
- Do I need to sign a data share contract with Zoho in order to comply with GDPR?
- Where can I fill out emergency contact details for Zoho data breach notifications?

Hello Michelangelo,

1. You can export data from our application as per your need anytime. You can filter out only the necessary records and export the same to cater to user-specific data requests.

2. You can check out https://accounts.zoho.com/u/h#privacy/dpa (zoho.com) or https://accounts.zoho.eu/u/h#privacy/dpa (zoho.eu) to initiate signing the DPA[Data Processing Addendum] (to be initiated by the Organisational Admin). You can also send us an email to gdpr-compliance@zohocorp.com, mentioning which data center you signed up in(zoho.com or zoho.eu) and we'll send you our DPA.

3. In case of a data breach, we will notify the affected user by email(to their primary email ID which they have signed up for in Zoho). If it involved disproportionate effort to communicate to all individually in case of a massive data breach, we will post the same as announcements in our Social handles(Twitter, LinkedIn and the like) & public media(where applicable).

Hi we are syncing crm with campaigns. Now I have a lot of contacts in campaigns list who need to give me the permission to sent them newsletter in future. What is the easiest way to ask them for their permission? Do you have guidline or tempaltes for this somewhere? thx

Hi Michael,

You can use our Consent Management and send consent email and acquire permission to send marketing emails. Navigate to Subscribers tab >> Manage Consent to create a consent email.

Our organization serves a US-only clientele. We wish to move towards GDPR as a good practice, but wondered if GDPR focuses on B2C interactions. Does the GDPR differentiate between business and personal email addresses?

Lastly, is there any litigation testing the validity or enforce-ability of the GDPR. (You can see my residence is in the US.)

We have created our contact lists from making calls and only hold basic contact details. Do we need all our contacts to agree to continue receiving our emails? They are b2b newsletters we send.

Thank you for your query.

It's quite a common question these days, ain't it. Well, to answer your query, I would like to just explain a couple of things.
These are the things you need to consider before making such a decision to a question such as this.

1. How did you get the information? Were the data subjects informed & given a choice to opt-in to receiving marketing communication from you?
2. What is the lawful basis to carry out this processing? Consent or legitimate interest or performance of a contract?
If it is legitimate interest, were the data subjects given a notice as to what they are to expect of the data you hold about them.
If it is consent, have you got the 'GDPR-standard' consent that the Law requires?
Have you given them a chance to opt-out of future communications / to withdraw their consent anytime?

Based on these questions and with the advise of your legal advisor, you can decide how to best proceed with this.

We are a Swiss business with a daughter company in the US, our main client base in the US & Canada (55%) and EU(40%). We heard from one of your agents, that in order to be compliant with the GDPR it is necessary that we move our data from zoho.com to zoho.eu.

We tried to migrate the data from our US Zoho Books account to a European Zoho Books account and this failed terribly. All additional addresses are lost, which is vital since we work with huge companies and we need to define to which department the goods have been shipped or billed to.

After reading again about the GDPR on your website, it seemed, that it is actually okay, to keep our accounts (CRM, Books, Projects, Reports and Campaigns) on the US servers. Can you please confirm this? In that case we would cancel the move of our data completely and would keep it where it is. Otherwise I would appreciate your help in regards of the exact import of invoices with the correct (additional) shipping and billing addresses.

Hello Robin,

Thank you for your query. With regards to Data Localisation, GDPR does not mandate that data be stored only within the EU territory. Rather it provides and approves mechanisms to facilitate the international transfers of data(Article 46). We have our Data Processing Addendum(for both US and EU DC's). You can initiate the signing process(if you are the Org Admin) by going to https://accounts.zoho.com/u/h#privacy/dpa (for US DC) .

Additionally, Zoho has certified it's compliance with the EU-US Privacy Shield which also is a legal transfer mechanism of data transfers between the EU and the US.

Dear Sushmitha,

I signed up through zoho.com years ago and my personal and business data on zoho is growing.

I am concerned about my privacy. Because of American legislation, I don't want my data sitting on US servers but rather on EU servers. (I currently work from South Africa.)

Does my data sit on US servers? And can I migrate my data to US servers? How ould I do that?
